On May 20, 2021, Massachusetts Lawyers Weekly featured on its front page an article relating to an Opinion rendered by Judge Stearns in a case pending in federal court. The subrogation case involves a 2016 fire loss that occurred on the historic Newbury Street in Boston. Shannon Warren and James “Jim” Yesu of ISG’s captive law firm Uehlein & Associates, LLC represent the Plaintiff, a subrogated insurer. The subrogated insurer defeated the Defendant’s Motion for Summary Judgment, which attempted to prelude its origin and cause investigator from rendering an expert opinion relative to causation, alleging that the investigator was relying on speculative evidence. In Plaintiff’s Opposition to Defendant’s Motion for Summary Judgment, it argued that its expert’s opinion was sufficiently reliable and admissible.
